Administrative History or Biographical Sketch

The Land Act of 1838 (7 William IV, c.118) formalised the transfer or assignment of granted land rights. In 1818 and in 1833, the government had enacted regulations designed to remove the substantial traffic in speculation of land rights gained by privilege, but without a significant degree of success. The Act of 1838 marked the end of these restrictions. Recognising that some individuals who were still entitled to free grants might not wish to retain ownership of their rights, the Act went on to specify that "such claims shall be assignable and transferable by the parties entitled thereto to any purchase or purchases thereof."

The following procedure was set down. The claimant of a free grant (the son or daughter of a Loyalist, a discharged soldier, or individual who had served in the militia) was to petition the Lieutenant-Governor stating the nature of his/her claim. In cases in which the claim was allowed and an Order-in-Council or warrant authorising the grant was issued, the grantee could then assign his/her rights to the grant to another person. To do this, all the grantee had to do was to draw up a contract of assignment stating the conditions of the transaction.

It was advisable to have the assignment registered by the Commissioner of Crown Lands. The Act of 1838 instructed the Commissioner to "keep a book for the entry of any particulars of any assignment made." Records were kept by the Commissioner only for assignments or transfers made before the land in question had been patented. Transfers of ownership subsequent to the issue of a patent were simply recorded in the local Registry Office.

Assignments involving other than free grants were also recorded by the Commissioner. In fact, assignments of land acquired by sale appear far more often in the registers than do assignments of free grant land.
