Scope and Content

Series consists of fiats for lease of Crown and clergy reserves issued under the Regulations of 1801 as well as related registers. Within the Surveyor General's Office, Old Regulations leases were identified with the code "O.R.".

Series is arranged into two sub-series based upon the format of the record.

Administrative History or Biographical Sketch

The procedure for applying for a lease of land was similar to that used in applying for a grant. In 1801 a plan to lease Crown and clergy reserves, largely drafted by D.W. Smith, the Surveyor General, was approved by the British government. Leases were issued for 21-year terms, with rents rising progressively at seven-year intervals. Local sheriffs were responsible for receiving rents and transmitting them to the Receiver General. For records-keeping and financial purposes, distinctions were kept between Crown and clergy reserve rentals. On 4 April 1811 the regulations relating to leases were revised, requiring a deposit from lessee and increasing rent payments.

Many offices were involved in the leasing process and each office (Executive Council Office, Receiver General's Office, Attorney General's Office, Surveyor General's Office, Provincial Secretary's Office, etc.) maintained its own numbering system for the documents it generated or received relating to these transactions. Within the Surveyor General's Office, Old Regulations fiats for leases were numbered and filed separately from other types of fiats.
