Scope and Content

Series consists of fiats, full fees, and related registers. In July 1804 a new table of fees - the Regulations of 6 July 1804 - was adopted, raising the fees which could be charged on grants and requiring payment of a small survey fee. After 1804, most grants to non-privileged persons were made under these regulations. It was a complex process to receive a land grant. Many offices were involved and each office (Executive Council Office, Receiver General's Office, Attorney General's Office, Surveyor General's Office, Provincial Secretary's Office, etc. ) maintained its own numbering system for the documents it generated or received relating to these transactions. Within the Surveyor General's Office, Full fee fiats were numbered and filed separately from other types of fiats. References to full fee land grants often are identified with the codes "RJ" or "F.F".

Within the Surveyor General's Office, the Attorney General's fiats relating to these grants were organised as a separate series.

While many of these fiats pertain to land grants to individual settlers, there are notable exceptions: fiats authorising grants of thousands of acres to the Canada Company; fiats relating to settlers originally located by Thomas Talbot; fiats related to those settled in eastern Ontario by McNab; and fiats ordering grants of large tracts of land to provincial surveyors such as Mahlon Burwell as compensation for laying out various townships. Increasingly, towards the end of the series, the fiats authorise grants to religious bodies and municipal bodies for church plots, cemeteries, school lots, market places, and so on. These grants were made under the authority of local acts made in 1841 (4 & 5 Vic., c. 100, s. 27) and 1860 (23 Vic., c. 2, s. 14).

Associated Material

Library and Archives Canada holds a register (Reference code RG 1 L 7, volume 14) recording warrants issued under the full fee regulations of 6 July 1804 (covering the period 23 March 1837 to 16 April 1845).

Library and Archives Canada also holds Executive Council records documenting payments of land made between 1819 and 1825 to surveyors for conducting surveys (Reference code: RG 1 L 6 B, volume 4).

Fiats were one of two types of authorities used to authorise full fee grants, generally in cases in which settlement duties were not required or were already completed. In cases where settlement duties were required but had not been fulfilled warrants were used. These warrants can be found in Series RG 1-148.
