Scope and Content

Series consists of individual warrants for land acquired "without purchase" under the authority of the Regulations of 21 November 1825 as well as registers of these records. By the mid-1820s, government officials were looking with increased favour on substituting a system of land sales for the free grant system. Details of the new sales plan, based on the New South Wales system implemented in Australia, were laid out in a minute of the Executive Council dated 21 November 1825. However, although the Regulation of 21 November 1825 introduced a system of land sales, privileged persons were still eligible for free grants and the acquisition of land "without purchase" was still permitted as an alternative to the sales system. The terms under which these lands "without purchase" were offered did not, in practice, differ greatly from those under the free grant system.

It was a complex process to receive a land grant. Many offices were involved and each office (Executive Council Office, Receiver General's Office, Attorney General's Office, Surveyor General's Office, Provincial Secretary's Office, etc. ) maintained its own numbering system for the documents it generated or received relating to these transactions. Within the Surveyor General's Office, warrants issued under the Regulations of 21November 1825 were numbered and filed separately from other types of fiats and warrants.
