Scope and Content

Series consists of indexes to orders- in-council and copies of orders-in council relating to land which were maintained in the Surveyor General's Office and later the Office of the Commissioner of Crown Lands, as authorisation for various land transactions including sales and grants.

A set of minute books (known as the Land Books) was kept by the Clerk of the Executive Council to record the deliberations and decisions of the Land Committee of the Executive Council. When written out in the form of an extract from the Land and State Books, these minutes were known as orders-in-council. Copies of early orders-in-council often can be found in the records of those government officials for whom the order provided the necessary authorization to take some sort of action, in this case, the records of the Surveyor General and the Commissioner of Crown Lands.

In addition to the order-in-council, there may be petitions, correspondence and receipts relating to the land transaction.

Series is arranged into five sub- series based upon the arrangement imposed by the creator of the records and/or format of the records.

Library and Archives Canada holds: Copybooks containing land-related orders-in-council sent to the Surveyor General from the Clerk of the Executive Council between 1819 and 1839 (Reference code: RG 1 L 6 B, volumes 16 and 18 and RG 1 L 7, volumes 19 and 20); andcopybooks containing land-related orders-in- council forwarded to the Commissioner of Crown Lands by the Clerk of the Executive Council between 1828 and 1844 (Reference code: RG 1 L 6 E, volumes 1 and 2).

Orders-in-Council relating to State matters (i.e., land policy, the acquisition and distribution of Indian lands, military reserves, and related topics), issued in the pre-Confederation period (1764-1867) are found in the Executive Council Minute Books (on State Matters), also known as the State Books, which are held by Library and Archives Canada as RG 1, E 1. Volumes 1 to 28 and 105 to 116 relate to the period preceeding the Constitutional Act (i.e., 1764-1791) while volumes 45 to 57 deal with Upper Canada.

Also at Library and Archives Canada are separate Orders-in-Council (RG 1, E 8) which serve as the official copy or "copy of record" for the period 1841 to 1867. These orders, bearing the Governor's initials as proof of his approval, were kept by the Clerk of the Council for future reference.
