Series consists of estate files containing the original documentation filed with the Surrogate Court for the Huron District (1842-1849), the United Counties of Huron, Bruce and Perth (1850-1852), the United Counties of Huron and Bruce (1853-1866) and the County of Huron (1867-) in proceedings leading to a grant of probate or administration.
Typically, an estate file includes the original will in cases of probate, administration bonds in cases of administration, petitions for probate or administration and supporting affidavits, and the order for probate or administration.
While some inventories of estates exist for the early period, the occurrence of these in the files becomes more frequent after 1892 when the Succession Duty Act required detailed inventories and lists of heirs to be included in the files of taxable estates. When the value of taxable estates was lowered by an amendment to the act in 1907, the presence of these inventories and lists becomes even more common.
If the will or the grant of probate or administration was contested, the estate file should also include the caveat filed against the estate, relevant citations and affidavits, and the final judgment issued by the court.
Files 1842-1855 are arranged alphabetically. Subsequently, they are filed numerically by grant number.

Ontario. Surrogate CourtsHuron County has started numbering their estate files on 4 separate occasions, resulting in several overlapping file sets. In the nominal index of the pre-1858 estate files available on-line, we have tried to keep these series separate by using the prefix OS (1840-1848); OS1 (1832-1856); OS2 (1838-1857); and OS3 (1851-1867). Even more confusing, the estate files in the first three series have no discernable alphabetical or chronological order.
The Archives of Ontario receives annual accruals to this series.

For the years 1855-1967, consult RG 22-2478 (Huron County Surrogate Court indexes) on GS 2, Reel 607. For those years after 1968 where the Archives does not hold an index, contact the Superior Court of Justice, 1 Courthouse Square, Goderich, Ontario, N7A 1M2 for a file number and year.

For 1859-1930 files, consult the self-service microfilm listing for Huron County available online in the Microfilm Interloan Catalogue or in the User's Guide to Surrogate Courts and Surrogate Clerk Microfilm Reels in the Archives' Reading Room.
